RESOLUTION
NO. 265
A RESOLUTION OF THE TOWN OF
SOUTH PRAIRIE, PIERCE COUNTY, WASHINGTON AMENDING RESOLUTION NO. 251 TO EXTEND THE FRANCHISE AGREEMENT BETWEEN
COMCAST OF PUGET SOUND INC. AND THE TOWN OF SOUTH PRAIRIE FOR ONE YEAR TO
OCTOBER 19, 2006.
Whereas,
Resolution No. 226 had extended the franchise between Cable TV Puget Sound
Inc., d/b/a AT&T Broadband and the Town to October 19, 2003, and
Whereas, Resolution No. 235 had
extended the franchise between Comcast of Puget Sound Inc. and the Town to
October 19, 2004, and
Whereas, Resolution No. 251 had
extended the franchise between Comcast of Puget Sound Inc. and the Town to
October 19, 2005, and
Whereas, the Town had previously contracted with Rainier
Communications for the purposes of negotiating a franchise, and
Whereas, the Town had
previously terminated its agreement with Rainier Communications and is
negotiating directly with Comcast of Puget Sound Inc., and
Whereas, the amount of time
required to conclude negotiations between the new negotiators will extend
beyond October 19, 2005, and
Whereas, following
negotiations there will be opportunities for public review and comment of the
proposed new Franchise Proposal and presentation to the Town Council, and
Whereas, the rights of all
parties will remain unchanged during the extension of the franchise, and
neither party waives any right which it enjoys under the law as the result of
agreeing to this extension.
Now, therefore, the Town Council
of the Town of South Prairie, Pierce County, Washington do
hereby resolve as follows:
Section
1: Resolution No. 251 is amended to
extend the Franchise Proposal between
Comcast of Puget Sound Inc. to October 19, 2006, or
the completion of the
franchise renewal negotiations, whichever occurs first.
