ORDINANCE NO. 401

AN ORDINANCE OF THE TOWN OF SOUTH PRAIRIE, PIERCE COUNTY, WASHINGTON AMENDING ORDINANCE NO. 349, DEALING WITH THE WATER UTILITY, TO INCREASE THE WATER RATES ANNUALLY AND CONTINUING ANNUAL INCREASES THEREAFTER.

 

 

Whereas, Ordinance No. 374 amended Ordinance No. 349 to authorize increases in water rates in the water utility annually beginning January 1, 2000, and

Whereas, there have been state initiatives and litigation concerning state initiatives on increasing rates and/or fees and/or taxes, and

 

 

Whereas, the effectiveness of such initiatives are unknown, and

 

 

Whereas, an increase in water rates is necessary to cover the expenses of the water utility, an enterprise fund, and

 

 

Whereas, the legal affect of Ordinance No. 374 is uncertain, and

 

 

Whereas, if Ordinance No. 374 is determined for any reason to be invalid the increase in the rates of the water utility is necessary, and

Whereas, it is projected the cost increase on an annual basis will be at least 3%, and

 

Whereas, it is in the public interest and for the benefit of public health, safety and welfare to have expenses covered by revenues in an enterprise account.

Now, therefore, the Town Council of the Town of South Prairie, Pierce County, Washington do ordain as follows:


Section 1: Ordinance No. 349, Section 6, Rates and Charges for Water, be amended as follows:

 

"Rates and Charges for Water: The rates and charges for water shall be based upon a system determined by the size of the pipe and the meter and a volume charge. For purposes of rate determination, the term referred to below as residential shall be one structure on one tax lot, or one individual living in it, such as a mobile home, recreational vehicle and/or apartment unit.

 

 

Commercial shall be anything other than the above.

 

 

The rates set forth in the "Water Utility Rate Schedule" attached hereto and incorporated by reference as if set out in full, as Exhibit "1", will begin on January 1, 2001 and shall be adjusted to the rate appearing below on January 1 of each following respective year.

 

 

The consumption charges set forth in the attached Exhibit "1" are an additional charge above the base rate representing the actual consumption of water use for each 100 cubic feet (CCF).

 

 

Out of Town Surcharge: There shall be an additional out of town surcharge applied to each account which shall be 20% above the billed amount, plus the above billed amount."

 

 

Section 2: All other provisions of Ordinance No. 349, except as specifically amended above, are hereby reaffirmed in all respects.

 

 

Section 3: If any provision of this ordinance, or Ordinance No. 349, is determined to be invalid or unenforceable for any reason, the remaining provisions of this ordinance, and/or Ordinance No. 349, shall remain in force and affect.


Section 3: This ordinance shall take effect and be in force on January 1, 2001.
