ORDINANCE NO. 400

AN ORDINANCE OF THE TOWN OF SOUTH PRAIRIE, PIERCE COUNTY, WASHINGTON ORDINANCE NO. 374 THAT AMENDED ORDINANCE NO. 349 DEALING WITH THE WATER UTILITY TO INCREASE WATER RATES ANNUALLY BEGINNING JANUARY 1, 2000 AND CONTINUING ANNUAL INCREASES THEREAFTER.

Whereas, Ordinance No. 374 was passed on October 26, 1999, and

Whereas, Ordinance No. 374 amended Ordinance No. 349 dealing with the water utility to increase the water rates annually beginning January 1, 2000 and continuing annual increases thereafter, and

Whereas, the increases are necessary to balance the water utility, which is an enterprise fund, and

Whereas, state initiatives and court rulings on state initiatives necessitate the reaffirmation of the action previously taken by the Town Council, and

Whereas, if the water utility does not receive the rate increases the expenses would exceed the revenues resulting in an insolvency in the enterprise fund.

Now, therefore, the Town Council of the Town of South Prairie, Pierce County, Washington do ordain as follows:

Section 1: Ordinance No. 374, amending Ordinance No. 349, Section 6, Rates and Charges for Waters, is hereby reaffirmed in its entirety.

Section 2: If any provision of this Ordinance, or Ordinance No. 349 and/or Ordinance No. 374, is determined to be invalid or unenforceable for any reason, the

remaining provisions of this Ordinance, and Ordinance No. 349 and/or Ordinance No. 374, shall remain in force and affect.

Section 3: This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication as required by law.
