ORDINANCE NO. 356
AN ORDINANCE OF THE TOWN OF SOUTH PRAIRIE, PIERCE COUNTY, WASHINGTON REPEALING ORDINANCE NO. 186 WHICH
ALLOWED PERMITTING FOR A TRAVEL
TRAILER OR RECREATIONAL VEHICLE MAY NOT BE USED FOR A RESIDENCY IN
EXCESS OF FIFTEEN (15) DAYS PER YEAR.
Whereas, Ordinance #186 was passed on
July 7, 1987, and
Whereas, under
that ordinance it is permissible to utilize a travel trailer for a residence if permitted,
and
Whereas, a travel trailer would
include recreational vehicles under the definitional terms of Ordinance #186, and
Whereas, the Town currently is on
a moratorium with regard to its sewer capacity, and
Whereas, the
allowing of a travel trailer or recreational vehicle to be
used as a residence would add another residential unit to the sewer system which is in violation of
the Washington State Department of Ecology (WDOE) moratorium, and
Whereas, a
maximum of fifteen (15) days per year to reside in a travel trailer or
recreational vehicle is reasonable to accommodate visiting guests.
Now, therefore, the Town Council of the
Town of South Prairie, Pierce County, Washington do ordain as follows:
Section 1: Ordinance #186 is repealed.
Section
2: Definitions: A travel trailer or
recreational vehicle (RV) shall mean any structure, originally
designed and manufactured to be
transportable and for the use as a permanent and/or temporary dwelling for human habitation. It specifically includes those structures commonly known as
"recreational vehicles, travel trailers, campers, and motor
homes".
Section 3:
Regulations: It shall be unlawful for the owner, operator or lessee of any
travel trailer, or any person in possession thereof
A. To park or cause to
permit the travel trailer to stand or to be parked upon
any public street, avenue, park, alley, right of way or any other public place within the corporate limits of
the Town for more than 48 consecutive hours.
B. To cause or prevent the
travel trailer to be used for living and/or sleeping
quarters upon any private property within the Town for more than fifteen (15) days, except if in a permitted RV
Park.
Section
4: Penalties: Violations of this ordinance
shall be a misdemeanor and punishable up to a maximum of
one year and/or $5,000.00.
Section 5: If any
provision of this ordinance is determined to be unenforceable or invalid for any reason, the
remaining provisions shall remain in force and affect.
Section 6: This ordinance shall take effect and be in full
force five (5) days from and after its passage, approval and publication as
required by law.
