ORDINANCE NO. 403

AN ORDINANCE OF THE TOWN OF SOUTH PRAIRIE, PIERCE COUNTY, WASHINGTON RE-ENACTING, APPROVING AND CONFIRMING THE INCREASE IN SEWER RATES AS ESTABLISHED IN ORDINANCE NO. 375.

Whereas, Ordinance No. 350 established a comprehensive sewer ordinance, including but not limited to the rates and charges for sewer at Section 6, and

Whereas, Ordinance No. 375 passed October 26, 1999 amended Ordinance No. 350, Section 3, on sewer connection fees and rates and charges for sewer use, and

Whereas, State Initiative 722, passed and then was challenged and a temporary injunction issued, and

Whereas, the status of Initiative 722 is uncertain, and

Whereas, it has been recommended by the Association of Washington Cities, AWC, that the Town take action to re-enact rate increases, and

Whereas, this ordinance effects the sewer utility, which is essential for the public health, safety and welfare, and

Whereas, the sewer utility is an enterprise fund in which the integrity of this type of fund must be maintained by providing the revenues sufficient to cover its expenses and capital costs, and


Whereas, there have been certain increases and expenses within the sewer fund that must be covered by revenues which can only be generated by increases in rates, and

Whereas, this ordinance is essential to the protection of the rate increase which is necessary to cover the expenses and maintain the integrity of the fund.

Now, therefore, the Town Council of the Town of South Prairie, Pierce County, Washington do ordain as follows:

Section 1: Ordinance No. 375 which increased the sewer rates beginning January 1, 2000 and on January 1st of each year thereafter, and increase the sewer connection fees, is hereby re-enacted, approved and confirmed.

Section 2: If any provision of this ordinance, or Ordinance No. 375 is held to be invalid or unenforceable for any reason, the remaining provisions of this ordinance, and/or Ordinance No. 375 shall be held in full force and affect.

Section 3: This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication as required by law.
