ORDINANCE NO. 372
AN ORDINANCE OF THE TOWN OF SOUTH PRAIRIE, PIERCE COUNTY, WASHINGTON AMENDING
SECTION 16 OF ORDINANCE NO. 350 TO PROVIDE THAT UPON THE TRANSFER
OF OWNERSHIP OF PROPERTY THE SEPTIC TANK SHALL BE PUMPED BY THE TOWN AT THE
EXPENSE OF A SELLER OR BUYER.
Whereas, Ordinance
No. 350 was a comprehensive sewer ordinance, and
Whereas, Section 16 of Ordinance No.
350 provided for a septic tank pumping in the event of transfer of ownership, and
Whereas, the town desires to clarify
that the town shall pump the septic tanks at the expense of the seller or buyer,
and
Whereas, by the town contracting the
pumping of the septic tank, it can assure that its systems are protected, and
Whereas,
protection of the sewer treatment plant is for the benefit of public
health, safety and welfare.
Now, therefore,
the Town Council of the Town of South Prairie, Pierce
County, Washington do ordain as follows:
Section
1: Ordinance No. 350, Section 16 shall be
amended to read as follows:
Section 16: Ownership of System: Upon
completion of the hookup to the sewer system, all materials from the
septic tank, including the septic tank, shall be the property of
the Town sewer system. The Town sewer system shall be
responsible for septic tank pumping except in the event of transfer
of ownership the septic tank shall be pumped by the town at the
expense of the seller or buyer. During the initial construction of the sewer
system it shall be the property owner's responsibility to connect between the
house and the septic tank. After completion of the sewer system, and for new
construction, it shall be the property owner's responsibility to install and
connect to the Town sewer system.

Section
2: All other provisions of Ordinance No. 350
shall remain in force and effect, accept as
specifically amended above.
Section 3: If any
provision of this ordinance or Ordinance No. 350 is determined to be invalid or
unenforceable for any reason, the remaining
provisions of this ordinance and/or Ordinance No. 350 shall remain in
force and effect.
Section : This ordinance shall take effect and be in force five (5) days from and after its passage,
approval and publication as required by law.
