ORDINANCE NO. 297

AN ORDINANCE OF THE TOWN OF SOUTH PRAIRIE, PIERCE COUNTY, WASHINGTON IMPLEMENTING A MORATORIUM FOR SEWER HOOK UPS FOR 6 MONTHS YEAR OR SOONER IF SEWER TREATMENT FACILITIES ARE CORRECTED.

 

 

Whereas, the Town operates a sewer treatment facility, and

 

Whereas, the Town received notice of a violation from the Washington State Department of Ecology, and

 

Whereas, the Town desires to comply with the rules and regulations of the State and Federal governments, and

 

Whereas, the continual hook ups and additional discharge into the sewer treatment facility will cause further problems, and

 

Whereas, the ultimate correction for the environmental violations are unknown at this time, and

 

Whereas, public health, safety and welfare are at risk if additional connections are made without corrections to the system, and

 

Whereas, the affect of this ordinance will be to enhance the environment, and

 

Whereas, an emergency is declared to exist resulting in the immediate implementation of the ordinance to prevent further environmental problems to protect the public health, safety and welfare.

 

Now, therefore, the Town Council of the Town of South Prairie, Pierce County, Washington do ordain as follows:

 

Section 1:, Effective on passage of this ordinance there shall be a moratorium on sewer connections in the Town of South Prairie.

 

Section 2: This ordinance shall be effective for 6 months or if corrections are sooner made to the sewer treatment facilities to eliminate environmental concerns as to discharge in South Prairie Creek.

 

Section 3: If any provision of this ordinance is declared to be invalid or unenforceable for any reason, the remaining provisions of this ordinance shall remain in force and affect.

Section 4: This ordinance is to take effect immediately, if it is determined that an emergency did not exist, and the ordinance cannot take effect immediately, then this ordinance shall take effect five (5) days from and after its passage, approval and publication as required by law.
