ORDINANCE NO. 280
Whereas, Ordinance No. 212 passed on February 14, 1990 provided for the annexation
of
certain property, owned by the Town, for the purposes of constructing a sewer
treatment facility, and
Whereas,
subsequent to the passage of ordinance No. 212 it was determined that the westerly twenty foot wide strip of the right-of-way
between described parcels in Ordinance No. 212 and the corporate limits of South Prairie were omitted from the
ordinance, and
Whereas, the Town wishes to include said westerly twenty foot wide strip of the
right-of-way between the described
parcels in Ordinance No. 212 and the corporate limits of South Prairie, and
Whereas, the Town of South Prairie passed Ordinance No. 256 setting forth the
correct legal description of said westerly 20 foot wide strip of the
right-of-way between the described parcels
in Ordinance No. 212 and the corporate limits of South Prairie, and would like
to amend Ordinance No. 256, Section 1.
Now, therefore, the Town Council of the Town of
South Prairie, Pierce County, Washington do ordain as follows:
Section 1: Section 1 of Ordinance No. 256 shall be amended to read as follows:
The following described real property, owned by the
Town of South Prairie, located east
and to the southeast of the Town, known as the "McGehee Property" legally described to wit:
Beginning at the southeast corner of the Paul Emery
Donation Land Claim in 'section 13, township 19, north, range 5 east
of the Willamette meridian, in Pierce County, Washington; thence north 454.7
feet on the east line of said Donation Land Claim to the point of beginning; thence west 211 feet and 7
inches; thence north
650 feet and 5 inches to the Northern Pacific
Railway right of way "now
abandoned"; thence continuing north on a projected line to the center line
of the Northern Pacific Railway right of way; thence north easterly along said
center line 217 feet more or less to its intersection with the east line of the
Paul Emery Donation Land Claim; thence south along said east line to the point
of beginning.

hereby annexed to the Town of South Prairie.
Section 2: That the Town
Clerk/Treasurer is authorized and directed to forward a copy of this ordinance
to the Washington State Boundary Review Board for Pierce County, and a
certified copy of this ordinance to the Pierce County Recorder, for recording,
as provided by law.
Section 3: If any provision of this
ordinance, or any ordinance affected by it is held invalid or unenforceable for
any reason, the remaining provisions shall remain in full force and affect.
Section 4: This
ordinance shall take affect and be in force five (5) days after its passage, approval and publication as required by law.
