ORDINANCE NO. 231
AN ORDINANCE OF THE TOWN OF SOUTH PRAIRIE, PIERCE COUNTY, WASHINGTON
CREATING PROCEDURES FOR LOT LINE ADJUSTMENTS
WHEREAS, requests by the public
have necessitated the establishment of
the definition and procedures for a lot line
adjustment for the orderly development
of real estate within the Town which is necessary for the public health,
safety and welfare.
NOW, THEREFORE, the Town Council of the
Town of South Prairie, Pierce
County, Washington do ordain as follows:
Section 1: Definition: The boundary lines
separating two or more lots of record may be adjusted under
provisions of this ordinance; provided, that such adjustment:
a. Will not
result in the creation of any additional lot, tract, parcel, site or division; and
b. Will not create any lot, tract, parcel,
site or division which contains insufficient area and dimensions to
meet the requirements of the zoning ordinance of the Town; and
c.
Will not adversely affect access, easements or
drainfields; and
d.
Will be consistent with applicable health, building or
similar regulations.
Section 2: Application: Application for a lot line adjustment shall be made
in writing to the Town and shall be submitted to the building official together with applicable fee and two
copies of the plan, drawn to scale
and accurately dimensioned, shading the following information:
a.
The proposed lot line for the affected lots, indicated by
heavy solid lines; and
b.
Existing lot lines proposed to be changed, indicated by
heavy broken lines; and
c.
Location of all structures existing upon the affected
lots; and
d. Location and dimensions
of any drainfield, easement or right of way existing within or adjacent
to any affected-lot; and
e. The area and dimensions of each lot following
the proposed adjustment; and
f. The
existing and, if applicable, proposed future method of sewage disposal for each
affected lot.Ordinance No.: 231
Section 3: Review: The building official
shall forward one copy of the proposed lot line adjustment plan to the
planning commission for its approval
or disapproval, which shall then forward its
decision to the applicant, the applicant shall then record the lot
line adjustment with Pierce County
within thirty (30) days or the lot line adjustment shall be null and
void.
Section 4: Appeal: An aggrieved person may
appeal the decision of the Planning Commission on a lot line adjustment to
the Town Council by filing the appeal
in writing, within thirty (30) days of the decision of the Planning
Commission.
Section 5: If any provision of this
ordinance is determined to be unenforceable or invalid for any reason, the
remaining provisions shall remain in force and affect.
Section 6: This ordinance shall
take affect and be in force five (5)
days from and after its passage, approval
and publication as required by law.
