ORDINANCE NO. 380
AN ORDINANCE OF THE TOWN OF SOUTH PRAIRIE, PIERCE COUNTY,
WASHINGTON AUTHORIZING THE ESTABLISHMENT OF FEES INCLUDING BUT NOT LIMITED TO
LAND USE FEES BY RESOLUTION.
Whereas, the Town is
required to provide certain services to the public, which services
are particular to an individual and which services costs the Town to provide, and
Whereas, the specific individual services require a fee to be
established to allow the covering of governmental costs for the providing
of such service which as a result would be borne by the person requesting the
service and not by the general taxpayers of the Town, and
Whereas, the establishment of fees for certain land use services is
consistent with the Comprehensive Plan and assures adequate funds available to pay
for staff time and consultant time, and
Whereas, in many cases a consultant must be retained to review
certain applications because there is inadequate staff or expertise available,
and
Whereas, it is appropriate and fair to the general taxpayer to
require an applicant to pay for the costs of the Town processing certain items
which are specific to an applicant and for paying the costs of consultants
which review certain applications which are specific to an applicant, and
Whereas, the Town desires from time to time to establish such fees
by Resolution to allow ease in updating the fees to reflect the actual costs
and to provide for an ultimate consolidated fee system for all services of the
Town.
Now, therefore, the Town Council of the Town of South Prairie, Pierce
County, Washington do ordain as follows:
Section 1: Fees and costs of consultants may be
established from time to time by Resolution.
Section 2: If any provision of this ordinance, or
the Fee Resolution authorized by this ordinance is determined to be invalid or
unenforceable for any reason,
the remaining provisions of this ordinance, and/or the Fee Resolution shall remain in force and affect.
Section 3: This Ordinance shall take effect and be in force five
(5) day from an after its passage, approval
and publication as required by law.
