ORDINANCE NO. 451
AN ORDINANCE OF THE TOWN OF SOUTH PRAIRIE, PIERCE
COUNTY, WASHINGTON ADOPTING THE 2003 INTERNATIONAL FIRE CODE, THE WASHINGTON
STATE AMENDMENTS, FUTURE AMENDMENTS TO THE INTERNATIONAL FIRE CODE, FUTURE
WASHINGTON STATE AMENDMENTS, AND REPEALING PRIOR CODES OR SECTIONS INCONSISTENT
WITH THE CODES ADOPTED HEREIN OR AMENDMENTS.
Whereas, the
international code council has promulgated the 2003 edition of the
International Fire Code, and
Whereas, the
Town desires to adopt the most recent editions of the codes for the protection
of public health, safety and welfare, and
Whereas, the 2003 edition of the International Fire Code
provides for regulating and governing the safeguarding of life and property
from fire and explosion hazards arising from the storage, handling and use of
hazardous substances, materials and devices, and from conditions hazardous to
life or property in the occupancy of buildings and premises as herein
providing; providing for the issuance of permits and collection of fees; and
for each and all of the regulations, provisions, penalties, conditions and
terms of said Fire Code on file, and
Whereas, the 2003 edition of the International Fire Code is
consistent with the Comprehensive Plan and has no adverse environmental affect,
and
Whereas, copies of the code are available as set forth by law
for public inspection.
Now, therefore, the Town
Council of the Town of South Prairie, Pierce County, Washington do ordain as
follows:
Section 1: Hereby adopts and
incorporates by reference as if set out in full the 2003 edition of the
International Fire Code, Washington State amendments, future amendments to the
2003 International Fire Code and Washington State amendments.
Section 2: Any ordinances that are
inconsistent with the 2003 edition of the International Fire Code, or
provisions therein are hereby repealed.
Section 3: Adopts or modifies the
following sections to the 2003 edition of the International Fire Code:
Section 101.1: Town of South Prairie
Section 109.3: Misdemeanor - $1,000 / 90 days.
Section 111.4: Double permit costs - $5,000.
Section 4: If any provision of this
ordinance, the 2003 edition of the International Fire Code, Washington State
amendments, or later amendments thereto, are determined to be invalid or
unenforceable for any reason, the remaining provisions of this ordinance, the
2003 edition of the International Fire Code, Washington State amendments, and
future amendments shall remain in force and affect.
Section 5: This
ordinance shall take effect and be in force five (5) days from and after its
passage, approval and publication as required by law.
