ORDINANCE NO. 323
AN ORDINANCE OF THE TOWN OF SOUTH PRAIRIE,
PIERCE COUNTY, WASHINGTON ADOPTING THE
"SOUTH PRAIRIE COMPREHENSIVE PLAN" PURSUANT TO THE GROWTH MANAGEMENT ACT, CHAPTER 36.70A RCW
AND ADOPTING FINDINGS OF FACT.
Whereas, the Growth
Management Act, codified as Chapter 36.70A, RCW, set forth in part legislative
findings that uncoordinated and unplanned
growth, together with lack of common goals,
expressing the public interest in the conservation and wise use of our lands, pose a threat to the
environment, sustainable economic
development, and the health, safety and high quality of life enjoyed by residents of this State. The
legislature further found that it is
in the public interest that citizens, communities, local governments and the private sector cooperate
and coordinate with one another in
comprehensive land use planning. To further this legislative mandate,
South Prairie has undertaken to extensively update its Comprehensive Plan, and
Whereas, in its update of its
Comprehensive Plan, South Prairie has
followed the goals as set forth in Section 36.70A.020, and
Whereas, the South
Prairie Comprehensive Plan is consistent with Chapter
36.70A, RCW and Washington Administrative Code 365-195, and
Whereas, public
hearings were held before the South Prairie Planning
Commission which Planning Commission recommended adoption to the Town
Council, and
Whereas, a
public hearing was held before the Town Council,
and
Whereas, an early and continuous
public participation in compliance with the Growth Management Act was provided,
and
Whereas, copies
of the South Prairie Comprehensive Plan were circulated to
designated State and local agencies which in turn made comment and
relevant changes were completed based upon comments received, and
Whereas, the
South Prairie Comprehensive Plan is consistent with
applicable growth management related plans from Pierce County, and the inter-jurisdictional agencies such as the
Puget Sound Regional Council, and
Whereas, the
South Prairie Comprehensive Plan is consistent with the
Pierce County Comprehensive Plan and the county wide planning policies,
and
Whereas, in
compliance with the State Environmental Policy Act,
Chapter 43.21C, RCW environmental review has been completed, and
Whereas, an
Environmental Impact Statement was completed for the South Prairie Comprehensive Plan, and
Whereas, the generalized proposed Land
Use Map is consistent with the Comprehensive Plan, and
Whereas, the
adoption of the South Prairie Comprehensive Plan is in the
public interest, protects the public health, safety and welfare and
complies with the Growth Management Act.
Now, therefore, the Town Council of the Town of South
Prairie, Pierce County, Washington do ordain as follows:
Section 1: The prior South Prairie Comprehensive Plan, which was entitled South Prairie Comprehensive Plan, is
hereby repealed in those areas
superseded by Comprehensive Plan as adopted in Section 2 below except as
to the zoning map.
Section 2: There is
hereby adopted the South Prairie Comprehensive
Plan as set forth on Exhibit "1" attached hereto and
incorporated by reference as if set out in full.
Section 3: If any
provision of this ordinance and the South Prairie
Comprehensive Plan, attached as Exhibit "1", is determined to be invalid or unenforceable for any reason, the
remaining provisions
of this ordinance and the South Prairie Comprehensive Plan, attached as Exhibit "1", shall
remain in force and affect. If any
provision of the existing zoning map is held to be invalid or unenforceable for any reason the remaining provisions
of that zoning map shall be
determined to be in force and affect.
Section 4: This ordinance shall take affect and be in force five (5) days from and after its passage, approval
and publication as required by law.
