ORDINANCE NO. 378
AN ORDINANCE OF THE TOWN
OF SOUTH PRAIRIE, PIERCE COUNTY, WASHINGTON ADOPTING UNIFIED DEVELOPMENT
REGULATIONS AND REPEALING THE FOLLOWING REGULATIONS THAT ARE REPLACED BY
UNIFIED DEVELOPMENT REGULATIONS, ORDINANCE NO. 161 SUBDIVISION; ORDINANCE
NO. 162 LAND DIVISION; ORDINANCE NO. 163 ENVIRONMENTAL PROCEDURES; ORDINANCE
NO. 164 AMENDMENTS TO ORDINANCE NO. 162; ORDINANCE NO. 282 SETBACKS; ORDINANCE NO.
309 SUBDIVISION STANDARDS; ORDINANCE 313 INTERIM ZONING, DECLARING NO ADVERSE
ENVIRONMENTAL SIGNIFICANCE.
Whereas, the Town has retained
Mark Kask and Associates to develop regulations in compliance with the Growth
Management Act; and
Whereas, public hearings have been held before the Planning
Commission; and
Whereas, the Unified Development Regulations supersede
other regulations contained within Ordinances
Nos. 161, 162, 163, 164, 282, 309 and 313; and
Whereas,
the
development regulations adopted herein are consistent with the Comprehensive
Plan, and
Whereas,
the adoption
of the Unified Development Regulations and the repeals do not have any adverse
environmental affects, and
Whereas,
it is for the benefit of the
public health, safety and welfare that the Unified Development Regulations are
promogated.
Now,
therefore, the Town Council of the Town of South Prairie, Pierce County,
Washington do ordain as follows:
Section 1: Ordinance No. 162, Subdivision Ordinance; No. 162 Land
Division Ordinance; No. 163 Environmental Procedures Ordinance; No. 164
Amendments to Ordinance No. 162; No. 282 Setbacks Ordinance; No. 309
Subdivision Standards Ordinance and No. 313 Interim Zoning Ordinance are hereby
repealed.
Section 2: There is hereby incorporated by reference
and adopted the Unified Development Regulations, which are attached hereto and
incorporated by reference as Exhibit "1" as if set out in full. (*Note: UDR in file in
Town Hall).
Section 3: If any provision of this ordinance or any provision of the
Unified Development Regulations adopted by this ordinance are determined to be
invalid or unenforceable for any reason, the remaining provisions of this
ordinance, and the Unified Development Regulations shall remain in full force
and affect.
Section
4:
This
Ordinance shall take effect and be in force five (5) day from an after its
passage, approval and publication as required by law.
