ORDINANCE NO. 322
AN ORDINANCE OF THE TOWN OF SOUTH PRAIRIE,
PIERCE COUNTY, WASHINGTON ADOPTING THE SHORELINE MANAGEMENT MASTER PROGRAM OF
DECEMBER 7, 1995.
Whereas, cities and towns are
required to promulgate a Shoreline Management Master Program, and
Whereas, the town received funding for the preparation
of the above plan through a cooperative
agreement with the National Oceanic and Atmospheric Administration, and
Whereas, consultants have prepared
a report, attached as
Exhibit "1" entitled Town of South
Prairie Grant No. G9600036
"Shoreline
Management Master Program (SMP)" dated December 7,1995,
and
Whereas, the SMP is in compliance
with the State Growth Management Act and the Comprehensive Plan of the town,
and
Whereas, the development of the
SMP does not have an adverse environmental effect, and
Whereas, the SMP is for the
benefit of public health, safety
and welfare, and
Whereas, development of the SMP is
necessary to protect the
valued
water resource of the town and flowing through the town, and
Whereas, compliance with the SMP
will enhance the fishery of
the South Prairie Creek,
and
Whereas, public hearings have been
held on the SMP, and Whereas, the SMP is on file with the town clerk and
available
for public inspection during regular business hours.
Now,
therefore, the Town Council of the Town of South Prairie, Pierce County, Washington
do ordain as follows:
Section 1: The town hereby adopts Exhibit "1", attached
hereto and incorporated by reference as if set out in full, the Town of South
Prairie Grant No. G9600036 entitled "Shoreline Management Master Program
(SMP)" dated December 7, 1995.
Section 2: If
any provision of this ordinance or the exhibit
incorporated by this ordinance is determined to be invalid or unenforceable for
any reason, the remaining provisions of this ordinance and the exhibit
incorporated by it shall remain in force and
effect.
Section 3: That a copy of Exhibit "1" shall be on file with
the town clerk and available for
public inspection during regular business
hours.
Section 4: This ordinance shall take effect and be in force five (5) days from and after its passage,
approval and publication as required by law.
