ORDINANCE NO. 325
AN ORDINANCE OF THE TOWN OF SOUTH PRAIRIE, PIERCE COUNTY,
WASHINGTON REPEALING ORDINANCE NO. 285, RE-ESTABLISHING THE REQUIRING THE
INSTALLATION OF CONCRETE SIDEWALKS, FIVE FEET IN WIDTH, AS A REQUIREMENT
FOR A SHORT PLAT, LONG PLAT, OR BUILDING PERMIT FOR A SUBSTANTIAL PROJECT.
Whereas, much of the town has
already been platted, and Whereas, prior platting requirements 'did
not require the installation of sidewalks, and
Whereas, for public health, safety and welfare sidewalks are necessary to separate
pedestrian traffic from vehicular traffic, and
Whereas, the requirement of construction of a five foot in width concrete sidewalk
is reasonable and is necessary to make for safe conditions of the citizens, and
Whereas, the requirement is in harmony with the
Comprehensive Plan, and
Whereas, the requirement of a
five foot in width sidewalk is reasonable to integrate and match all sidewalks together,
and
Whereas,
this
requirement does not have an adverse environmental impact.
Now,
therefore, the Town Council of the Town of South Prairie, Pierce County, Washington
do ordain as follows:
Section 1: As a condition for any short plat or long plat, or the issuance of a
building permit for a substantial project, will
require
the construction of a concrete sidewalk, five feet in width.
Section 2: A building permit for a substantial project shall be a project
where the cost of the entire project is equal to or greater than 50% of the county assessed value of
the structures on the property.
Section 3: If any provision of this ordinance is held invalid or
unenforceable for any reason, the remaining provisions shall remain in
full force and affect.
Section 4: This ordinance shall take affect and be in force five (5)
days from and after its passage, approval and publication as required by
law.
